Entre agosto y noviembre de 2022, la Asociación Nacional de Industriales (ANDI) desarrolló una propuesta regulatoria sobre el trabajo a distancia que implica una simplificación y armonización del marco regulatorio existente. Esta propuesta toma en consideración un análisis de las diferentes leyes existentes en torno a modalidades concernientes al trabajo a distancia (leyes sobre teletrabajo, trabajo en casa y trabajo remoto, además de las disposiciones del código de trabajo sobre trabajo a domicilio y acuerdo de voluntades), para realizar una consolidación de estas en un único marco regulatorio que salvaguarda los derechos del trabajador y los aspectos como la eficiencia y productividad de la empresa. Todo ello con la justificación añadida de favorecer un modelo estable y ajustado a las necesidades en este ámbito que se han hecho patentes para el sector empresarial tras la crisis de la COVID-19. Esta propuesta de proyecto de ley fue presentada por la ANDI en 2023 en los siguientes espacios: 1) En los comités de laboralistas en los que participan los empresarios afiliados a la ANDI: • Medellín (7 de febrero y 26 de mayo de 2023) • Bogotá (22 de febrero y 31 de mayo de 2023) • Barranquilla y Cartagena (1 de junio de 2023) • Cali y Cauca (29 de mayo de 2023) 2) Webinar nacional dirigida por el presidente de la ANDI a todos los empresarios (15 de marzo de 2023). 3) Presentación a la Subcomisión técnica de reforma laboral, conformada de manera tripartita por el Ministerio del Trabajo(marzo de 2023). 4) Presentación de propuestas en audiencia pública del Congreso de la República por parte del presidente de la ANDI, Bruce Mac Master (8 de mayo de 2023). 5) Presentación de propuestas ante el Foro realizado por la Comisión Accidental de Productividad, Pequeñas y Medianas Empresas (18 de mayo de 2023). 6) Presentación de propuestas ANDI frente a la reforma laboral a congresistas de la Comisión séptima de la cámara de representantes (abril, mayo y junio de 2023). La OIT prestó apoyo y orientaciones específicas a la ANDI desde el inicio del proceso. En junio de 2022, se apoyó con asistencia técnica a varios profesionales de la Vicepresidencia de Asuntos Jurídicos para diseñar el proyecto de investigación, apoyados también por un profesional del Centro de Estudios Sociales y Laborales (CESLA) de la ANDI. Se analizaron las condiciones del contexto en el que se realizaría el proyecto, identificando el problema a resolver y las formas que el proceso de cooperación podría adoptar. También se colaboró con la ANDI para identificar algunos ejemplos de regulación eficiente en materia de teletrabajo en otras realidades nacionales . En octubre de 2022, la OIT proporcionó un listado de comentarios de fondo y sugerencias para mejorar el primer borrador elaborado por un colaborador externo bajo la supervisión de la Vicepresidencia de Asuntos Jurídicos. Luego de ello, la ANDI organizó dos reuniones (una en octubre y otra en noviembre de 2022) para llegar a un texto final que produjera el mayor impacto posible. El documento fue presentado a finales de noviembre de 2022.
